Yeah, the more I read, the more I gotta ask: Is it just a matter of time before some law maker in my (respective) country notices the 800 pound gorilla in the room? Or some law enforcement official, or DA issues a subpoena?
These are real concerns wherever the dler is. I don't have to look far to see cases of law enforcment coming down on people in America who posess materials similar to what will be the final product of Katawa Shoujo. I donated some money to the Comic Book Legal Defense Fund on this one because the grey area on which these prosecutors were so readily going to imprison a man was just unacceptable in my mind.
At any rate, I don't expect the staff to change their decision. They've made their case. Hopefully, this will never get the ear of some zealo t.

Hmm... well, at least the Judge did rule against those two clauses, which is a strong bonus to all of us, and there is no real ability to make a case that Katawa Shoujo lacks literary or artistic value or happens to be patently offensive. It ISN'T an "Ooh, cripple, rape!" sort of game, after all. So in America, at least, we're probably fine. Ditto for Japan, though for somewhat different reasons.

Another point, what about the developers? I don't know where they are living, but I guess some of them live in one of those countries with such hard laws.
What if one of the artists who drew such an H-scene could suddenly be drawn to court?
What about the other people involved in the making, could they be charged as well?
I don't know if I'm being paranoid, but I think this is a serious issue, and I rather have a finished game without explicit pictures than no game at all...

I'm inclined to think no prosecution could be brought against the katawa shoujo developers, especially since they don't use their real names. The project as a whole could never be outright banned as it doesn't belong to any one country since the devs are from multiple countries, and though if they were found theoretically one of the developers could probably be prosecuted I doubt it would get very far. Though I don't exactly have intimate knowledge of the law I'm inclined to believe they are ok.
Is it really just a game, or is it a religious experience.

agreed. "Love scenes" would make a lot more sense. Make the H in this game artistic and flow smoothly with the plot or not at all. There is a fine line between between a passionate love scene and base and boring pron. But there *is* a line and I think the writers are talented enough to make real quality love scenes that wont detract from the quality of the game.
I'm surprised that this is all being done for free.

I know Wikipedia isn't fact, but the amount of references the article has pretty much disagrees.
You may be playing the game, full stop. But then afterwards you may look at a heavy fine, time in jail, and your name in the sex offender's register.
I'd love to play this game as well. However, our country sucks, and plans on making our lives that little bit less free and dull. Just to put it into perspective, this law would make things like Family Guy, South Park, and Watchmen illegal. Even the Simpsons could be banned.

I don't think people that don't usually play VNs and/or surf the internet for hentai of all sorts would be interested in playing a game where you can date cripples.
A lot of people will probably find the game as offensive and ban it for various reasons, whether or not it has porn in it.

Is the (tasteful) depiction of a sexual act without explicitely showing any genitals considerd pornography?
As far as I know, porn is defined by explicitely showing erected penises, vaginas, etc, so it would be no pornography.
So, if the persons depicted were minors, would it then be considered pornography while it's not when they were adults?
Also the ages of the protagonists aren't given, they could as well be 18 or 19...

I can make a beautiful drawing of a lady that many people call art and there will still be one of those really annoying people that babbles about morality, children, yadda-yadda-yadda.
The worst thing about it is they can actually sue and win if they find a judge that's as bad as them.

Any sexual act involving a minor, or any sexual act in the presence of a minor will be banned. Also, a minor counts for anyone who could be considered underage, meaning as long as they are flat chested or look cute, someone can see them as underage and so 'underage'. Those non-government groups were trying to get Japan on board with the banning of underage hentai. Japan just laughed at them. Makes sense, seeing a large portion of their economy relies upon it, and most of their citizens would be in jail otherwise.
