Technically with some verbal weaseling, you could technically prove that the game has artistic merit.
"esp" is the key word here, or rather what it stands for- especially. It can still be pornographic with artistic merit, it's just that the word especially refers to those without it.

It's a pretty banal book, it's only on the reading list because it was written by an Australian.

However, it does feature students aged 16-20 having sex.

I figure if non-pornographic sex is acceptable by the state government, then I have nothing to fear. Worst case, I share a cell with the dude that wrote the book and I can smash his face in as stress relief.
Keep in mind that there is a very famous book and movie that is critically acclaimed in the United States regarding the subject of a guy who's a pedophile. I actually have not read or seen the movie, though.

Books can always get away with things that videogames can't.

Edit: Just read a synopses of "Tomorrow, When the War Began", and I can't help but think of similarities to the movie "Red Dawn".

Humbert Humbert never gets to put it in Dear Dolores or really ever do much sexually with her at all and even then Lolita got a lot of bad press.

Great book, wonderfully written but I wouldn't really use it as an example of a book that got away with depictions of underage sex.

Like I said, I haven't read the book. I just figured that we could come up with a defence if we show that there are many other (accepted) works which depict or imply the very thing they would attack KS on. Maybe I'll pick up the book and actually see what it's all about.

Seriously though, if someone is bothered by a depiction of a guy around 18 years old banging a 17 year old girl, there's something seriously wrong with them. Age of consent here in Minnesota is 16, anyways.

Is that so? I would disagree with that definition. I don't think you define porn by it's artistic merit or lack thereof. I would define pornography as material that is designed for sexual stimulation, or something along those lines.

@Validus - well the premise is kind of similar in that way but the similarities end there - its a serious look at the themes of war, innocence and growing up.

That's the reason why the definition uses the word "especially."
esp. those having little or no artistic merit.
I would have to agree that most of what is classified as pornography has no artistic merit whatsoever. KS and similar works like it are the exception, and I'm far from ready to throw KS under the label of pornography yet.

Sweet! Just like Mobile Suit Gundam! Oh wait, you said serious...[/sarcasm]

Joking aside, I think I'll take a look at it. The number of books I want to read is starting to pile up now, lol.

It is a great book in fact it's my favorite, Nabokov is a genius.
More importantly though it's a spoiler Humbert totally has sex with her. Or perhaps she has sex with him is another way to look at it. Either way there most definitely was insertion.
