IMO, I like realistic backgrounds, it makes KS stand out from other VN's... to this date, I have not seen another VN with photos for backgrounds.
Leaving the issue of gaining consent from school staff, I think that it wouldn't be much of a problem if the pictures did not include the logo/crest of the school i.e just generic classrooms that look like any other classroom... as for the outdoor pics, it could be any building that resembles a school, while omitting/photoshopping any logos or signs that might make the place recognizable

Anyways, I think realistic backgrounds are great as well but they do have their limitations. The writers have to write to the limit of the photos taken rather than writing the story and then being able to create backgrounds to go along with it. But in the case of KS I believe this was the best choice. I think it fits the character art better than would a drawn background but an interesting point was broung up about photograph permission. I also don't think many institutions wouldn't allow the photos to be taken if they know what this game is about; they would simply see an H-game about cripples. That is not what we see but it would be hard to convince people who are in said positions to allow for something that one of the students could see and say "Hey, that's my classroom theyr'e in." And the all popular, "Their doing it on my desk!"

That's rather sad. I've never seen a school that didn't at least have a monthly case of hanky-panky on the tables. You'd think they'd accept it as a given.

I know its sad... but honestly, I think its a sadder case when the lawyers start knocking on the photographers door.
But before we deviate too much from the topic... photo backgrounds are much better than drawn ones, I think because they take less effort than drawn backgrounds and they stand out... also, I was quickly going over vndb.org and I ran into some... VN's.. if you call them, look at this one for example (http://www.renai.us/game/realife.shtml)... lol if a good amount of english VN's are like this, then KS is going to pwn the english VN market

Drawn backgrounds are useful for a number of reasons. Firstly (as has been previously mentioned) there are a lot of legal issues with using photography. KS and other minor projects may go under the radar, but big name companies will certainly attract flak for using certain locations. The second reason is that drawn backgrounds can be tailored to suit the needs of the situation, whereas finding a real location may be impractical or impossible.

Okay, I think this at least is getting a little silly. Concerning the "I don't think there is/haven't seen another VN with filtered photos for backgrounds": TSUKIHIME.
I even remember a Japanese site where people had hunted down more or less all the locations where the photos were taken, or practically identical ones. Same thing goes for at least some of the Fate/Stay Night backgrounds, which have real-world equivalents, despite being drawn.
I'm sure you will find more if you dig around a little; but anyway my point is, photofiltered BGs are neither a particularly brilliant gem of originality nor especially ghetto.

Well, if I recall correctly, Tsukihime was done when the group was still a doujin group as opposed to a proper company. Doujins usually get turned a blind eye. Also, a lot of drawn backgrounds are done from some sort of reference and are simply changed slightly to avoid sticky legal complications. Drawn backgrounds are simply more prolific since they avoid sticky legal red tape and allow more popular usually.

Haruhi Suzumiya uses backgrounds from the author's home town (and the school now puts up no trespassing signs because they've gotten so many tourists show up).
Wouldn't it be great if Brown ended up getting Haruhi'd by KS? And by great I mean hilarious.
Anyway, I can't really see any legal issues coming up, if only because KS is free. If 4LS were making money off of unauthorized photos, that might be another matter.
True, KS is unlikely to get any trouble from the backgrounds, firstly because it is (as you said) free, and secondly because it is such a small project. In Japan, small armies can be amassed at the slightest reference in a doujin game or something. In comparison, the english speaking anime, manga, vn fanbase is so much smaller and so much more subdued that its nigh impossible for serious mainstream fuss to occur. I doubt Brown University staff has ever even heard the name KS.

Hurr durr durr. There are no legal issues. Every photo source in KS either we own or is in PD. The ones that are taken on public property we are free to do anything with, including using them as backgrounds for a porn game, free or commercial. The closest to something sketchy are the ones from Brown, and only if the campus is private property (I don't remember if it is, and in fact our photographer might've even asked for authorization when he took the photos. He's a polite dude.)
